Terms of Service

These terms govern your use of Sonder, operated by Evan Troesh ("Sonder," "we," "us," or "our"). By creating an account or using the service, you agree to be bound by these terms. If you do not agree, do not use Sonder.

1. The Service

Sonder is a personal relationship management tool — a private space to organize notes, interactions, and reminders about the people in your life. We provide it as a convenience; nothing in Sonder constitutes medical, legal, financial, psychological, or other professional advice. You are solely responsible for how you use the information stored in your account.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. Where possible, we will provide advance notice of significant changes.

2. Eligibility and Your Account

You must be at least 13 years old to use Sonder. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

3. User Content and License

The notes, contacts, interactions, and other content you create in Sonder ("User Content") remain yours. You retain all ownership rights to your User Content.

By using Sonder, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely as necessary to operate the service for you. This license terminates when you delete the relevant content or your account.

By using AI features (Quick Capture, Profile Summary, Note Cleanup, etc.), you grant us an additional limited license to transmit the relevant portions of your User Content to Anthropic's API for processing. We transmit only what is needed for the specific feature you triggered.

You represent that you have the right to store any information you enter into Sonder, and that doing so does not violate any law or third-party rights.

4. Acceptable Use

Sonder is designed for personal, private relationship management. You agree not to:

We reserve the right to investigate suspected violations and to suspend or terminate accounts without notice when we reasonably believe a violation has occurred.

5. Subscription and Payment

Sonder offers a free tier (up to 10 contacts) and a paid membership tier at $4 per month (or the price displayed at checkout). Payments are processed by Stripe.

6. Intellectual Property

Sonder's code, design, interface, trademarks, and brand — including the name "Sonder," the S-mark logo, and all visual elements — are owned by Evan Troesh and are protected by applicable intellectual property laws. These terms do not grant you any right to use them.

Your User Content is yours. Sonder's code and design are ours.

7. Termination

You may delete your account at any time from Settings → Account. Deletion is immediate and permanent.

We may suspend or terminate your account and access to the service, with or without notice, if we believe you have violated these terms, engaged in fraudulent activity, or if required by law. Upon termination for cause, we have no obligation to refund any amounts paid.

If we discontinue the service or terminate your account without cause, we will provide reasonable notice and refund any prepaid, unused subscription fees on a pro-rata basis.

8. Indemnification

You agree to defend, indemnify, and hold harmless Evan Troesh and any officers, employees, contractors, or agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of Sonder; (b) your User Content; (c) your violation of these terms; or (d) your violation of any law or third-party right. We reserve the right to assume exclusive control of any matter subject to indemnification, at your expense.

9. Disclaimer of Warranties

SONDER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY AI-GENERATED OUTPUT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVAN TROESH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE SONDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO SONDER EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE DOLLARS (USD $25).

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In those jurisdictions, the above limitations apply to the fullest extent permitted by law.

11. Dispute Resolution and Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before initiating any formal dispute, you agree to contact us at evan@troesh.net and attempt to resolve the matter informally for at least 30 days.

Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising from or relating to these terms or Sonder — except for small claims court matters — shall be resolved by binding individual arbitration under the JAMS Streamlined Arbitration Rules, administered in San Francisco, California (or by video or telephone). Judgment on the award may be entered in any court of competent jurisdiction. Arbitration costs will be allocated per JAMS rules.

Class action waiver. YOU AND EVAN TROESH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims or preside over any class proceeding.

Jury trial waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE ANY RIGHT TO A TRIAL BY JURY.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12. General Provisions

Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and Evan Troesh regarding Sonder and supersede all prior agreements or understandings.

Severability. If any provision of these terms is found invalid or unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision of these terms is not a waiver of our right to enforce it in the future.

Assignment. You may not assign or transfer your rights under these terms without our prior written consent. We may assign our rights and obligations under these terms freely, including in connection with a sale or transfer of the business. These terms will bind and benefit any successors and assigns.

Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, government actions, Internet outages, or third-party service failures.

No third-party beneficiaries. These terms do not create any third-party beneficiary rights.

Notices. We may provide notices to you at your registered email address. Notices to us should be sent to evan@troesh.net.

13. Changes to These Terms

We may update these terms from time to time. For material changes, we will provide at least 14 days' notice by email or in-app announcement before the new terms take effect. Continued use of Sonder after the effective date constitutes acceptance of the revised terms. If you do not agree to the revised terms, you may delete your account before they take effect.
